These Terms of Service ("Terms") govern your use of the StorePromoKit website and application ("Service") operated by StorePromoKit ("we", "our", "us").

By creating an account or using the Service, you agree to these Terms.

1. Your Account

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you suspect unauthorized access to your account.

You must be at least 16 years old to use StorePromoKit.

2. What You Can Do

StorePromoKit grants you a limited, non-exclusive, non-transferable right to use the Service for creating and managing weekly promotional materials for retail stores, subject to these Terms and the limitations of your subscription plan.

3. Your Content

You retain ownership of all content you upload or create in StorePromoKit, including product data, images, prices, and generated flyer layouts ("Your Content").

By using the Service, you grant us a limited license to process, store, and display Your Content solely for the purpose of providing the Service to you. This license ends when you delete Your Content or your account.

You are responsible for ensuring you have the right to use any images, text, or other materials you upload. You must not upload content that infringes third-party intellectual property rights.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload malicious code or attempt to compromise the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or redistribute access to the Service without authorization
• Use the Service to create content that is defamatory, harassing, or promotes violence
• Circumvent usage limits or subscription restrictions
• Use automated tools to access the Service (except through our official API if available on your plan)

5. Subscription and Payment

StorePromoKit offers subscription plans with varying features and limits. Plan details, pricing, and limits are described on our pricing page.

• Billing: Subscriptions are billed monthly or annually, depending on your selection. Payment is due at the start of each billing period.
• Upgrades and downgrades: You may change your plan at any time. Upgrades take effect immediately; downgrades take effect at the start of the next billing period.
• Refunds: We do not offer refunds for partial billing periods. You may cancel at any time, and your access will continue until the end of the current billing period.
• Free trial: Trial accounts have limited features and usage as described on the pricing page. No payment is required during the trial.

6. Promotion Boost Packs

Promotion Boost Packs are one-time purchases that add extra promotion capacity and AI image credits to your account for the current billing period. Boost Packs are non-refundable and do not carry over to the next billing period.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime or service interruptions.

8. Intellectual Property

StorePromoKit, its logo, design, and underlying technology are our intellectual property. These Terms do not grant you any rights to our branding, trademarks, or proprietary technology beyond the right to use the Service as described here.

9. Limitation of Liability

To the maximum extent permitted by law, StorePromoKit is provided "as is" without warranties of any kind. We are not liable for:

• Loss of data, revenue, or business opportunities
• Errors in generated flyer layouts or print output quality
• Third-party service failures (payment processing, hosting, image services)
• Indirect, incidental, or consequential damages

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Account Termination

You may delete your account at any time. Upon deletion, Your Content will be removed from our servers within 30 days.

We may suspend or terminate your account if you violate these Terms, with notice where practicable. In the event of termination for violation, no refund will be issued.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law
